1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your access to and use of SendroAI, a Software-as-a-Service (SaaS) platform for AI-powered inside-sales email generation and campaign automation. SendroAI is owned and operated by OmniAgentic Innovations LLP, a registered Limited Liability Partnership with its principal place of business in Pune, India.

By accessing, registering for, or using SendroAI, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

2. Service Description

SendroAI is an email marketing automation platform that utilizes artificial intelligence to generate, personalize, and optimize inside-sales email campaigns and sequences. Our platform provides tools for:

• AI-powered email content generation and personalization
• Multi-touch email sequence automation
• Campaign analytics and performance tracking
• Inbox rotation and deliverability management
• Integration with third-party email delivery services
• Lead management and campaign optimization

3. Account Registration and Free Trial

To use SendroAI, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

14-Day Free Trial: New users are entitled to a 14-day free trial with complete access to SendroAI's features. No credit card is required to begin the trial. At the end of the trial period, you may choose to subscribe to a paid plan or your access will be terminated.

4. Subscription Plans and Billing

SendroAI offers multiple subscription tiers available on monthly and yearly billing cycles. By subscribing, you authorize us to charge your designated payment method at the beginning of each billing cycle.

No Refund Policy: All subscription fees are non-refundable. We do not provide full, partial, or prorated refunds under any circumstances. This policy is final and applies to all plans and billing cycles.

5. Subscription Cancellation

You may cancel your subscription at any time through your account dashboard or by contacting support. Cancellation takes effect at the end of your current billing cycle. You will retain full access to the platform until that time, but no refunds will be issued for the remaining period.

6. Acceptable Use Policy

You agree to use SendroAI only for lawful purposes and in compliance with all applicable laws and regulations. You expressly agree NOT to use SendroAI for:

• Spam: Sending unsolicited bulk email or marketing messages to recipients who have not opted in
• Harassment: Sending threatening, abusive, defamatory, or harassing communications
• Illegal Activities: Engaging in fraud, phishing, malware distribution, or any other illegal activity
• Data Scraping: Harvesting email addresses or personal data without consent
• Impersonation: Misrepresenting your identity or affiliation
• Violation of Third-Party Rights: Infringing on intellectual property, privacy, or other rights

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

7. Compliance with Email Marketing Laws

You are solely responsible for ensuring your use of SendroAI complies with all applicable email marketing laws and regulations, including but not limited to:

• CAN-SPAM Act (United States): Requires accurate sender information, clear subject lines, opt-out mechanisms, and honoring unsubscribe requests
• GDPR (European Union): Requires lawful basis for processing personal data, consent for marketing communications, and data subject rights
• CASL (Canada): Requires express or implied consent before sending commercial electronic messages
• Other Regional Laws: Compliance with local anti-spam and data protection regulations in your jurisdiction

SendroAI provides tools to help facilitate compliance, but ultimate legal responsibility rests with you as the sender.

8. Third-Party Services and Integrations

SendroAI integrates with various third-party services to provide functionality, including:

• Razorpay: Payment processing
• Mailgun: Email delivery infrastructure
• Odoo: Billing and invoice management
• Google OAuth: Authentication services
• Supabase: Backend infrastructure and data storage

Your use of these third-party services is subject to their respective terms and privacy policies. OmniAgentic Innovations LLP is not responsible for the performance, availability, or policies of these third-party services.

9. Limitation of Liability

To the maximum extent permitted by law, OmniAgentic Innovations LLP and SendroAI shall not be liable for:

• Any misuse of the platform by you or your authorized users
• Third-party service outages or failures (Mailgun, Razorpay, Odoo, Google Auth, Supabase, etc.)
• Email deliverability rates, spam filtering, or inbox placement
• Lost revenue, business opportunities, data, or profits
• Indirect, incidental, consequential, or punitive damages
• Service interruptions, bugs, or technical issues
• Legal claims arising from your violation of email marketing laws

Our total liability to you for any claim arising from your use of SendroAI shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Data and Privacy

We collect and process personal data as described in our Privacy Policy. By using SendroAI, you consent to our data practices as outlined in that policy.

We implement industry-standard security measures to protect your data, but we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.

11. Analytics and Cookies

SendroAI uses cookies and similar tracking technologies to improve user experience, analyze platform usage, and provide personalized features. By using our platform, you consent to our use of cookies as described in our Privacy Policy.

You may configure your browser to reject cookies, but this may limit your ability to use certain features of the platform.

12. Intellectual Property

All content, features, functionality, trademarks, and intellectual property associated with SendroAI are owned by OmniAgentic Innovations LLP. You are granted a limited, non-exclusive, non-transferable license to use the platform solely for its intended purpose.

You retain ownership of the email content and data you create using SendroAI, but you grant us a license to process and transmit that content as necessary to provide the service.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the platform. Your continued use of SendroAI after such modifications constitutes acceptance of the updated Terms.

14. Termination

We reserve the right to suspend or terminate your account immediately, without prior notice, if you violate these Terms or engage in conduct that we deem harmful to SendroAI, other users, or third parties.

Upon termination, your right to access and use the platform will immediately cease, and we may delete your data in accordance with our data retention policies.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of SendroAI shall be subject to the exclusive jurisdiction of the courts in Pune, India.
